Dear Applicant,
I am announcing the availability of the Caremark Rx L.L.C. settlement fund grants. The grants are the result of the settlement negotiated by the Ohio Attorney General's Office with Caremark Rx L.L.C. This negotiated settlement resolves claims that Caremark Rx L.L.C. violated state and federal statutes and regulations by switching dosage forms of certain commonly prescribed medications. In strict accord with the Agreed Entry and Final Judgment Order, the Ohio Attorney General's Office will distribute the funds to:
The Ohio Attorney General's Office is accepting applications from qualified non-profit corporations and charitable organizations that meet the requirements set forth in the Agreed Entry and Final Judgment Order as indicated above. Applications are expected from, but are not limited to, free-clinics, not-for-profit hospitals, and community organizations that provide health care or other related services to benefit low income, disabled, or elderly consumers of prescriptive medications, or that promote lower drug costs for Ohio residents, or that provide educational or other related programs.
The Ohio Attorney General's Office has developed a process to be used by qualified applicants. This letter, the Verification of Registration with the State of Ohio Attorney General’s Office, the Application Instructions, Application Cover Page and Application Narrative contain the information needed (see Related Documents below). The Verification of Registration form is to be filed prior to application submission. All application materials and program updates are available at www.ag.state.oh.us. The deadline for applications is June 28, 2008. Applications received in the Ohio Attorney General's Office postmarked by June 28, 2008 will be considered for funding. The completed application shall serve as the submission and only the application will be considered by the Caremark Rx L.L.C.Discretionary Settlement Fund Distribution Committee. The decision of the Caremark Rx L.L.C.Discretionary Settlement Fund Distribution Committee is final. Applicants will be notified of the decision in writing within eight weeks after the deadline. Grant recipients will be required to sign the Recipient Agreement with the Ohio Attorney General's Office. At the conclusion of the Grant Period, the grant recipients are required to file the Final Financial Report which includes copies of purchase orders and expenditure receipts. The Recipient Agreement and the Final Financial Report are available at the AG website for preview prior to application submission. Funds will be distributed to grant recipients after the Ohio Attorney General's Office receives the signed Recipient Agreement, including the Declaration Regarding Material Assistance/Non-assistance to a Terrorist Organization (Agreement Item #6).
